H1B Extension Process

People from all over the world hanker to get to United States, to work there. This is because this country is full of opportunities for people from various fields.   1. One is not eligible for file adjustment status application, if one belongs from country having no current priority date and mainly happens for applications coming from the citizens of China and India
  2. The person applying for H1B extension must have green card employment petition under EB2, EB1, and EB3 category.

After six years of work in United States (H1b Extension After 6 Years ), the H1B visa period expires .But another concept has been introduced by US government, which states that it can be extended beyond six years but only for one year. If that person needs to stay more, he has to renew this every year.

Criteria for H1B extension after six years:

  1. If the person applying for this, is a beneficiary of the employment base immigrant (EB) under the petition of I-140
  2. If the application for labor certificate of employment green card remained pending by more than one year.

H1B extension processing time:

Various important documents are required for H1B extension like Original I-94 form issue by USCIS, USCIS I-797 form receipt, updated visa of the family members and others. If the application form is fulfilled correctly and if all the required documents are provided in proper status as required, the H1B extension processing time is nearly about three to six months. In actual practice, the renewal of the visa after three years of expiry takes lesser time than the extension after six years because extension for this visa after six years is a very special case and a very detail scrutiny of various documents and applicant’s status is done before approval. Therefore, it takes more time.
